NATURE OF THE CASE: Santos (P) appealed a summary judgment for Sugar (D) in P's action for breach of contract.
FACTS: P and D executed a hauling contract in October 1980. It stated that P shall transport such tonnage of beets as may be loaded by D and unload said beets at locations designated by D. The term of the contract shall be from October 1, 1980, until February 15, 1981. P knew he was just one of many contractors. In early December 1980, D informed P that his services would no longer be needed. P sued D contending he was entitled to continue to haul until all of the beets had been transported. Thus, D wrongfully terminated the contract. The court granted summary judgment to D and P appealed.
