NATURE OF THE CASE: Martin (D) appealed the judgment of the Circuit Court, which convicted him of public drunkenness.
FACTS: Martin (D) was arrested at his home and the officers who did so took him onto a public highway wherein D manifested his drunken condition by using loud and profane language in a manner that suggested he was intoxicated. D was convicted of being drunk on a public highway. D appealed.
