NATURE OF THE CASE: This case involves the mens rea requirement. The mens rea requirement
deals with the defendant's level of knowledge about his wrongful conduct. Specific intent
crimes require that the defendant knew that what he did was unlawful. General intent crimes
have a more lenient standard of mens rea, as the case below demonstrates.
FACTS: On January 11, 1991, Milton Fox (D) was charged with possession of ephedrine.
Possession of ephedrine has been illegal in Idaho since 1988. D received 100,000 tablets of
the substance via an out of state mail order catalogue. D claimed that since he did not know
that ephedrine was an illegal substance, the mens rea element of his crime was never
satisfied.
