NATURE OF THE CASE: This case deals with the mens rea required in a general intent
possession case.
FACTS: The defendants were indicted for possession of unregistered hand grenades in
violation of a federal statute. The defendants claimed that they never knew that possession
of the unregistered hand grenades was illegal. The district court dismissed the indictments
on the grounds that due process was violated by failure to allege a mens rea. The government
appeals.
