NATURE OF THE CASE: This was a dispute over contract interpretation related to a request for increased payments.
FACTS: Elec-Trol (P) agreed to perform subcontracting work for North Baptist Hospital (D1). The agreement between P and the general contractor, Kern (D), incorporated the terms of the contract between D-D1. P sought additional compensation for its work based on specification changes. D and D1 contend that P has been fully compensated. D moved for a summary judgment and it was granted and P appealed.
