NATURE OF THE CASE: This was a dispute over the closing of steel plants.
FACTS: U.S. Steel (D) closed two large steel production facilities and laid off the
workers. The trade union (P) sued to enjoin the closure or at least force D to sell the
facilities to P. D claimed that the facilities were unprofitable and asserted an absolute
right to make a business decision to discharge its employees and abandon the facility. D was
initially restrained from closure but a formal opinion was entered holding the plants were
unprofitable and denied all relief. P appealed.
