NATURE OF THE CASE: TUV (D) motioned for summary judgment Maizitis (P) filed an Amended
Memorandum in Response to D's Motion for Summary Judgment.
FACTS: P accepted a promotion to the position of service unit manager with D. P got a
$10,000 salary increase. P also had to sign a nonsolicitation agreement. P worked for two
years when his position was eliminated and his employment was terminated. The
non-solicitation clause expired on May 22, 2004. P filed his Complaint on February 16, 2005.
