NATURE OF THE CASE: This was an appeal from a damages award from a breach of contract.
Hatter (D) appealed an order, which entered a jury verdict in favor of Potter (P).
FACTS: Hatter Farms (D) orally agreed to buy 192,000 young turkeys from Potter (P). All
the terms of the agreement were agreed upon except for transportation. P turned down other
offers for the turkeys in reliance on the oral offer he had with D. The parties could not
agree on transportation and D told P that he could not use the turkeys. P sued for breach.
The jury found for P. D appealed.
