NATURE OF THE CASE: This was an appeal from an award of a partial summary judgment.
FACTS: Scavenger (P), a computer game developer, brought an action against GT (D), a computer game distributor, for breach of contract. The contract between P and D called for separate production and payment schedules for four CD-Rom games P was to delivery to D. P delivered two of the games and did not delivery the other two.
